Substitutional Service of Documents by Social Media or Email.

North Central Process Service has been preparing affidavits in support of substitutional service by social media and email and serving Defendants for major law firms online by email and social media since 2014 and our Lead Investigator has been using metadata to determine geographic location since 2009 under contract to Revenue Canada Agency as a Civil Enforcement Bailiff. Substitutional service on a party by social media or email is only granted after a judge has been satisfied attempts to personally serve have been exhausted and the persons whereabouts can not be determined - there is a lengthy procedural process to get to that point - don't fall for misleading gimmicks minimizing the amount of work and cost involved to get to that point - and you, the filing party, will need to obtain the order from a Provincial Court Judge or a Master in Chambers and provide it to the Process Server in order to proceed with the service.  All social media companies and webmail service providers including but not limited to Google, Yahoo, Instagram, Twitter, and Facebook strip all location data from EXIF (photos) and email and any IP data that can be obtained will only provide rough geographic data - not an address - which you need to serve your documents. If you are serving a Provincial Court of Alberta (Civil) claim and you do not know the whereabouts of the Defendant, you must obtain a Limited Demographic Search (LDS) from registries, the form can be found here. Please note, a Date of Birth or previous address is required in order to obtain a LDS. Please see our Investigations page for more details on this service as we can obtain the Date of Birth and a previous address for you if you do not have it.

In Meads v. Meads 2012 ABQB 571, Justice Rooke recommends courts and businesses who deal with the public to take additional security measures to mitigate against increasing threats against Justice System Participants. As Public Officers as defined by the Criminal Code and licenced Investigators and Security through the Alberta Ministry of Justice and Solicitor General, our Process Servers are able to utilize Personal Protective Equipment (PPE) including Body Armour, Animal Repellent, Collapsible Batons, and any other equipment deemed necessary based on the threat level associated with undertaking civil action at private residences and rural and urban properties in order to ensure that the service of civil process goes as safely as possible for everyone involved. We document the service of civil process through Body Worn and Dash Cameras that date/time/GPS location stamp the video of the service or attempted service and any incidents that may arise, and unlike many of our competitors, our Process Servers only wear professional business casual attire to ensure that your firm is positively represented and we are fully insured for Commercial Liability, Failure to Perform, and Injury (WCB).
